There is no ‘stop-work order’

WE refer to the article titled “Hunza issues stop-work order to contractor a week after appointment” which appeared in The Edge Financial Daily on Sept 8.

We note that the report, which is based on our announcement to Bursa, has several inaccuracies.

The first paragraph states that “Slightly more than a week after two parties entered into a RM30.41 million CONSTRUCTION [] agreement, ...differences ... led the developers to issue a stop-work order against the contractor.”

The above is inaccurate because the High Court in Penang issued an interim injunction on Sept 3 against PLB-KH Bina. There was no stop-work order issued as reported and Hunza does not have any authority to issue stop-work orders.

For your information, PLB-KH Bina was awarded the contract on Jan 14, 2008, about one year and eight months ago.

The second paragraph states that HUNZA PROPERTIES [] BHD []’s wholly owned subsidiaries “had issued a stop-work summons to its contractor PLB-KH Bina Sdn Bhd”. There was no stop-work summons issued by the subsidiaries Hunza Properties (Gurney) Sdn Bhd (HPG) and Hunza Properties (Penang) Sdn Bhd (HPP). Hunza made an ex parte application to the High Court in Penang for an interim injunction by way of a Summons in Chambers.

The third paragraph states that the subsidiaries “...had awarded the contract to PLB-KH Bina via a letter dated Aug 26”. The letter dated Aug 26 was to determine the employment of PLB-KH Bina Sdn Bhd as a contractor.

The Notice of Arbitration was issued on Sept 3, eight days after the employment of PLB-KH Bina Sdn Bhd as a contractor was determined.

The tenth paragraph states that “This is not the first time that this particular development of Hunza has caused controversy”. We wish to state that there is nothing controversial about exercising the right to determine the employment of a contractor under the contract.
